The problem with using average judgment statistics is that they are very useless. why? A typical back injury case does not go to trial. So the average solution for a back injury will be different from the average decision.
So the best weapon, although far from perfect, is to look at back injuries comparable to your injury. It will not pay you the settlement compensation you would have received in your case, even if the facts appear to be the same. But a back injury settlement and decision model helps you better understand the potential limitations of your case.
Our lawyers prefer to look at median statistics rather than average statistics (which is how I started this post). With back injuries, there are far fewer injury claims and fewer back injury claims. These numbers distort the settlement average in a way that can be misleading. So I choose median statistics instead of averages.
Steroid injections increase the average compensation payment for back injury treatment. Epidural steroid injections signal to the insurance company that you have a more serious back injury. There are no statistics on how much it increases on average, and back injury settlements without surgery will almost always have less compensation than those with surgery.

Remember that every case is unique, and the factors that affect the solution can vary significantly from case to case.
Statistics, sample settlements, and jury verdicts give you a start in understanding the value range for your case. But they are only the beginning of the analysis. Statistics and previous cases cannot predict the value of your case. No back injury settlement calculation. Many variables are in combination to isolate the factors that drive these results as they are. There is no formula or metric for calculating an individual back injury claim settlement payment.
However, these examples of solutions and solutions for back injuries that I gave you above are not worthless. This is one of many tools at your disposal to help narrow your case’s potential trial range, which is ultimately the number that insurance companies will use to calculate your settlement compensation.

The term “back injury” is an umbrella term that refers to any and all injuries to the bones, discs, and nerves in the spine. Some common back injuries we see in personal injury cases include:
The potential settlement value for back injuries in tort cases is highly dependent on the type and extent of treatment the plaintiff receives.
Minor back injuries that require only pain medication and physical therapy have relatively low value. The next level of treatment in most cases of back injuries is epidural steroid injections. The third and highest level of treatment in back cases is usually spinal fusion surgery.

Spinal fusion is a surgical technique commonly used to treat back injuries that result in chronic pain. In spinal fusion surgery, two or more vertebrae in the spine are essentially welded or “fused” together into one bone. This fusing process is designed to eliminate chronic pain when the bones move independently.
Spinal fusion works by reducing the movement between two vertebrae which can be a source of chronic pain. Fusion in the bones of the spine also prevents stretching and pinching of nearby ligaments and nerves.
The idea is that if the vertebrae are immobilized through fusion, they will no longer cause chronic pain. Spinal fusion surgery is only an effective treatment option when movement is the source of pain and the location of the pain in the back is known.
As a general rule, in personal injury cases, all surgery greatly increases the potential settlement value of the plaintiff’s injuries. Whenever a plaintiff’s injuries require surgery, their tort case will have a higher potential settlement value. This is especially true in cases of back injuries that involve spinal fusion surgery.
What Is The Average Settlement For Car Accident Back And Neck Injury?
The factor that has the greatest impact on the value of a potential back injury settlement is the level of treatment the plaintiff undergoes. For most types of back injuries, there are three possible levels of medical treatment that may be needed:
Level 1 treatment for back injuries usually includes anti-inflammatory pain medication (eg, ibuprofen) and physical therapy.
If pain medication and physical therapy are not effective in relieving chronic pain from a back injury, the next level of treatment includes epidural steroid injections. This involves injecting an anti-inflammatory steroid medication directly into the epidural space in the spine. These injections (which can last for several months) relieve back pain by reducing inflammation and nerve irritation.
If Level 1 (medication and physical therapy) and Level 2 (steroid injections) are not effective in relieving back pain, the third and final level of treatment is usually spinal fusion surgery.

The average settlement value of a back injury claim will increase based on the level of treatment the plaintiff underwent. Whenever a back injury requires spinal fusion surgery, it can easily double or triple the potential value of the case.
There are two reasons for this. First, it is entitled to a portion of the damages that plaintiffs receive in personal injury cases involving medical expenses. More treatment equals more damage. The medical costs associated with spinal fusion surgery are much higher than the costs associated with Level 1 treatment.
A second reason that spinal fusion surgery significantly increases the value of a back injury case is that it validates the plaintiff’s injury and pain and suffering claim. If a back injury requires only Level 1 treatment, insurance adjusters (and adjudicators) take it less seriously. They will be more likely to discredit any alleged pain and suffering and value the claim. Conversely, whenever a back injury requires spinal fusion surgery (level 3 treatment) claims adjusters are forced to take it seriously and are less likely to dispute the plaintiff’s pain and suffering claims.
Note that all these statistics are incomplete. Any statistician deriving a methodology for calculating these numbers would have serious reservations about relying on these estimates as the true average spinal surgery clearance value. Does this make these statistics useless? I won’t say that. But note that this is not the same as looking at the average price of West Texas crude oil. Finally, you can dig up and find information to help you better estimate the settlement value of your claim. But every case is truly different, and the average settlement has no bearing on the actual settlement value of your claim.

The average compensation payout for a back injury lawsuit involving spinal fusion surgery is between $150,000 and $200,000. One factor that limits settlement value in spinal fusion auto tort cases is the limitations of applicable insurance coverage. Our attorneys have handled many cases where we were limited by insurance policy limits even though the claim had a much higher settlement value.
Spinal fusion surgery, like all types of surgery, may involve temporary pain and discomfort associated with the procedure. However, compared to other procedures, spinal fusion surgery does not involve a significant amount of post-surgical pain or difficult recovery.
