Settlement Amounts For Personal Injury – Yes, the location of the injury can significantly affect the amount of money a person receives in a personal injury settlement. Injuries to certain parts of the body, such as the head, neck, and spine, are often more severe and can lead to long-term problems such as pain, disability, and emotional distress. As a result, these injuries are usually worth more than injuries to other parts of the body.
Here is a general overview of the average personal injury amount for different body parts:

In addition to the location of the injury, other factors can affect the personal injury settlement amount:

If you have been injured in an accident, it is important to speak with an experienced personal injury attorney to discuss your case. An attorney can help you understand your legal rights and options and help you get the compensation you deserve.
The location of the injury can affect the amount of money you receive in a personal injury settlement. This is because different states have different laws governing personal injury lawsuits, and these laws can affect the amount of compensation available to injured plaintiffs.
For example, in some states plaintiffs may recover damages for pain and suffering, while in other states such damages are not available. In addition, the amount of compensation available to cover medical expenses may vary from state to state.
In addition to the laws of the state where you were injured, the specific circumstances of your case may affect the settlement amount. For example, if you were injured in a car accident, the settlement amount depends on the severity of your injuries, medical expenses, and the fault of the other driver.

Previous Previous How much do personal injury lawyers make? Next Next When Does Workers’ Comp Offer a Settlement This post examines the average settlement amount for back injury car accident claims. This page was last updated on December 14, 2021.
Let’s start with some statistics. A verdict and settlement database found that the average award awarded to a plaintiff in a motor vehicle case involving a back injury is $212,500.
For all car, truck and motorcycle accident injuries in the database that resulted in a plaintiff’s verdict, the median award is $300,000.
What The Human Body Is Worth — The Settled Suit
The difficulty with using average judgment statistics is that they are pretty useless. Why? The typical back injury case does not go to trial. So the average settlement for a back injury will differ from the average verdict.
So the better weapon, while far from perfect, is to look at back injuries similar to yours. This will not give you the compensation you will receive in your case, even if the facts appear to be the same. However, sample back injury settlements and verdicts will help you better understand the possible ranges for your case.
Our lawyers prefer to look at median statistics rather than average statistics (which is how I started this post). In relation to back injuries, there are so many extremely minor injury claims and fewer catastrophic back injury claims. These numbers distort the settlement average in a misleading way. Thus, I prefer the median statistic rather than the mean.
Steroid injections increase the average compensation payout for back injury settlements. Epidural steroid injections tell the insurer that you have a more serious back injury. There are no statistics on exactly how much the average increases, and non-surgical back injury settlements will almost always result in lower compensation than surgical ones.
What Is The Average Payout For Whiplash?
Remember that every case is unique and the factors affecting settlement can vary significantly from case to case.
Statistics, sample settlements and jury verdicts help you understand the value range of your case. But these are only the beginning of the analysis. Statistics and past cases cannot predict the value of a case. There is no back injury settlement calculator. There are too many variables in the mix to isolate the factors that caused these results to turn out the way they did. There is simply no formula or metric for calculating a settlement payment for an individual back injury claim.
However, these examples of back injury settlements and the judgments I have made above are not worthless. They are one of the tools at your disposal to narrow down the probable trial range of your case, which is ultimately the number that insurance companies use to calculate settlement damages.

Car Accidents And Personal Injury: Settlement Amount Expectations
I don’t have much of a headache, thanks to good hydration and good genetic luck. I have never had a traumatic head injury and only had two concussions. On the rare occasion I get a headache, it debilitates me. It’s really hard to enjoy life when you have anything but a mild headache.
Juries are struggling to figure out how to evaluate personal injury cases where the primary injury is a closed head injury that has caused—and may continue to cause—a headache.
Why? Because headaches are mostly subjective. Thus, the credibility of the plaintiff – which is usually 90% of the game in the trial – becomes the whole game, because you cannot know how much pain is in someone’s mind. Likewise, how do you demonstrate short-term memory loss? Instead, choose to believe that the victim’s report of pain or loss of function is what they say it is.
Of course, the objective injuries surrounding the claim – for example, the diagnosis of post-concussion syndrome – confirm the settlement value of the claims. But ultimately it depends on the credibility of the victim.
Average Settlement For Car Accident Back & Neck Injury
Prizes ranged from $1 to $14,810,734. One percent of awards for headache cases were over $1 million. This data is a bit older, but I’m sure the 2022 mean and median will be similar.
To put that into context, the average award for a personal injury case nationally is approximately $791,756. Is the verdict in headache cases 5% of the national average? This is not unreasonable in many cases. But I believe that in cases with significant impact and prolonged headache symptoms, such as post-concussion syndrome, which our attorneys often experience, the settlement payouts are much higher.
Median compensation for those under 18 was $7,463. For claimants between the ages of 19 and 39, the median payout was $8,858. Once you reach age 60, the bonus increases to $13,454. Here are some additional head injury compensation payment statistics of interest:
Verdicts in headache cases can exceed one million dollars, although rarely, as we have seen from the statistics above. What is the headache after car accident settlements and verdicts that the average case does not have?
Calculate Pain & Suffering In Personal Injury Claims
These head injury cases generally have three components: (1) objective head injury, (2) serious property damage, and (3) testimony from a physician who believes that (a) the headache was caused by the accident and (b) was not expected, to save the plaintiff from headaches in the future.
I am not saying that without them the plaintiff was not seriously injured. But getting seriously injured and getting a jury verdict commensurate with the head injury are two different things.
Interestingly, a full 42% of head injuries in car crashes in the study involved rear-end crashes. They accounted for 21% of the collisions at intersections and another 11% of the turning collisions. [It is important to remember that these settlement and verdict statistics are all civil tort cases. The law treats workers’ compensation cases differently, and the value of these cases is typically much lower.]
So the average verdict has gone up a lot, but the median verdict, which is much more telling, remains nearly the same.
Things You Can Do To Get A Larger Personal Injury Settlement
Below are settlements and verdicts for headache injury cases. You can find more Maryland cases (and a statement on the use of judgments) here. (I am writing on March 13, 2022.)
The plaintiff (47-year-old woman) worked as a delivery person. When he was delivering a package to the accused’s house, he was attacked by dogs and knocked down the stairs, causing him to hit the back of his head. The plaintiff suffered a head injury and required surgery. He also claimed that the head injury led to post-traumatic stress disorder (PTSD). He initiated premises liability proceedings against the homeowners. The case settled for $350,760.
A 57-year-old woman boarded a transit bus. Seconds later, the bus moved while she was still standing. The bus driver suddenly braked the vehicle. This caused the woman to fall to the floor. He suffered a headache, a concussion, and a cervical fracture
