There are three main options you can take if your K1 visa petition is denied, which can still provide a path to permanent cohabitation in the United States. These three options are to appeal the decision, reapply for a K1 visa, or marry in a foreign country and apply for a CR1 visa.

Applicants have 33 days after the USCIS consular provides a decision to appeal. The decision can be appealed using Form I-290B, a notice of appeal, or a petition. The appeal form is $630 to file regardless of the appeal decision. An appeal is a particularly good idea if you feel like the decision was based on inaccurate or incomplete information that you can clarify or provide that might change the consular decision.

Another option that many applicants choose is to simply reapply for the K1 visa. This may be the best option if mistakes were made during the K1 visa process that you can correct during a second petition process. However, it is important to remember that they will consider the initial decision during the second K1 visa petition, so a re-application should only be submitted if the stated reason for the petition being denied during a second petition can be properly addressed.

A third option that is often available to couples whose K1 visa petition has been denied is the CR1 visa. This visa allows the spouse of a US citizen to enter the United States as a permanent resident. However, usually the best way to obtain this visa after a K1 visa application has been denied is to marry your future spouse legally in another country. This is generally seen as a way Bypass the need to prove to the consular office that you and your future partner are serious about getting married, and they generally see a lower risk of fraud with a CR1 visa than with a K1 visa.

Form I 130, Explained

You applied for a nonimmigrant visa and the officer told you that you were denied? Or did you find out later, when you checked your status online, that you declined? Are you freaking out and don’t know what to do next and have no idea what “refused” means?

It will help guide you exactly how to check your visa status online and explain what it means to be “refused”. lets start!

First, depending on which US consulate you went to for your interview, you may have been told by an officer that you were denied pending administrative processing or that they required more information. If this is the case, they should have provided you with a letter or sent you an email, depending on the consulate, explaining what you Further work is required. The image below has some examples of what these might look like.

If you have not received a letter or email after your visa interview stating that you have been “refused”, then you will want to follow these steps to check the status of your application case online.

K 1 Visa Processing Time, Cost And Information

If your case status is “refused”, don’t worry! take a deep breath. Just because your status says “declined” doesn’t mean your case has been denied. Usually the fact that a non-immigrant case is rejected is because the consulate is either 1) conducting further research on your case, 2) has requested (or will request from you) more information to make a final decision or 3) has found it necessary to do additional security background checks. If the consulate requires additional documentation from you, they will usually ask for it in the interview and issue you a letter as shown above, or send an email with instructions on what they need and how to send it back to them. The consulate will usually keep your status as “refused” until they get what they need or complete any further processing they determine is necessary.

The consulate’s procedure for placing your case in “refusal” status can be very confusing. I do not agree with this process at all because it creates unnecessary pressure on the applicants while waiting for some kind of correspondence regarding their matter which is “pending” and not really “refused”. Denied is a strong word to use for “on hold”!

To avoid confusion as to the outcome of your interview, I strongly recommend that you do the following before you leave your interview:

If you were not approved on the spot, find out exactly what the officer needs from you in order to get your application back in line and processed quickly. Don’t be afraid to ask questions! The officer may not have all the answers at the moment, but the more information you can get from him, the better, so you know exactly what to expect.

Remember, even if you are told that you have been turned down for an interview or your online case status shows rejected, this does not mean that your application has automatically been rejected. More documentation is likely needed to complete their review and their administrative review process just takes longer than usual because they need to make sure everything is in order. If the request is denied, the officer must provide a clear, written reason why the request was denied.
